How to File a Case

Engage a Lawyer

While self-representation is possible, the High Court has complex procedural rules. It is strongly recommended to engage a registered legal practitioner.

Prepare Court Papers

Your lawyer will draft the necessary court papers — typically a summons with a declaration (for civil claims) or a court application with supporting affidavits.

File at the Court Registry

File the court papers at the High Court Registry and pay the filing fees.

Serve the Other Party

The court papers must be served on the defendant/respondent through the Sheriff of the High Court.

Pre-Trial Procedures

After the defendant files their response, there may be discovery (exchange of documents), pre-trial conferences, and other procedures before the trial or hearing.

Trial/Hearing

The case is heard by a High Court judge. Both parties present evidence and arguments. The judge delivers a judgment.

High Court Rules

The High Court operates under the High Court Rules (Statutory Instrument 202 of 2021). Key rules include:

  • All documents must be typed in a specific format (A4, double-spaced, numbered paragraphs)
  • Strict timelines for filing responses (typically 10-14 days after service)
  • Discovery rules require disclosure of relevant documents
  • Court dress code must be observed (professional attire)

Court Calendar

The High Court sits in four terms per year, with vacation periods between terms. The court calendar is published at the beginning of each year by the Judicial Service Commission. Emergency and urgent applications can be heard during vacation.
